Court of Cassation confirms victory of the Church of Scientology over UNADFI.
6 April 2010 - On March 30, 2010, after 21 years of court procedure, a decision of the Court of Cassation (the highest court in the French judiciary system) confirmed the victory of the Church of Scientology over UNADFI.
Last Tuesday, the Cassation Court rejected the appeal filed at the Court of Cassation by UNADFI (in a case pending against the Church of Scientology since 1989. In this case, the members of the
Church of Scientology had already been discharged due to lack of evidence, based on the final prosecution address which concluded that there had been no criminal offence.
However, the National Union of the Associations for the Defense of Family and Individual (UNADFI) sued relentlessly the Scientologists, being the only civil part in the case. This decision by the Cassation Court will probably create a legal precedent in confirming all decisions issued by various courts in the last 30 years and will dismiss UNADFI as a civil part in cases involving the Church of Scientology.
It must be made clear that this relentless filing suit on the part of UNADFI is carried out mostly at the cost of the French taxpayers. In fact, this group is funded up to more than 95% by public funds, which deprives the association of any legitimacy in a secular country such as France.
Danièle Gounord, spokesperson of the Church of Scientology, said: « This legal victory will allow the Church of Scientology to continue its expansion with serenity in France and to speed up its social improvement programs to fight drugs and illiteracy, to prevent crime or to promote human rights.
The Church of Scientology was founded in 1954 and has been present in France since 1960. The Church of Scientology has about 45,000 members in France.
